 캐나다 전문인력이민(Skilled Worker Class Immigration) 신청 방법
|

캐나다 전문인력이민(구 독립이민)을 원하시는 분들께서 가장 먼저
고려해야 할 사항은
(1) 자신의 경력 (2) 자격판정표에 의한 점수를 확인하는 것입니다.
자신의 경력이 NOC(캐나다 이민 신청이 가능한 직업분류표)에 해당되는지
확인하십시오. 그리고, 자격판정표를 참조하여 직종, 언어능력, 학력, 적응력, 나이 등의 점수를
더하여 총 점수가 67점 이상이라고 판단되신 분 들께서는 다음 과정을
참조하여 캐나다 이민을 신청하실 수 있습니다. 주의할 점은 직업 경력의
경우 반드시 동일한 직종의 경력만 인정된다는 것입니다. 예를들어 한사람의
경력이 Computer Programmer 2년 경력, Chemical Engineer 경력
2년이라고 가정하면 둘 중에서 자신의 전공과 관련된 한개의 직종이
선택되어야 하며, 경력 점수는 2년 경력에 해당하는 17점입니다. (이민자료실,

캐나다 이민 신청을 위해서 반드시 작성해야 하는 주요 서류는 Application for Permanent Residence in Canada [IMM 0008], [IMM 0008 SCEDULE 1], [IMM 5406]와 Police Certificates(신원확인조회)등
입니다. 다음은 이민신청서를 프린트하여 접수하는 방법입니다.
1. 캐나다 이민성 사이트 http://www.cic.gc.ca 로
들어갑니다. 또는 캐나다 대사관 한글 사이트 http://korea.gc.ca
를 참조합니다.
2. 왼쪽부분에서 >to Immigrate 를 선택합니다.
3. -> Skilled Worker Class Immigration 을 선택합니다.
이곳에 Online Self Assessment Tool이 있으므로 전문인력이민 자격 판정 테스트를 하실 수 있습니다. 자세한 내용은 <이민자료실> 또는 <이민정보>에서 [전문인력이민 자격판정표]를 참조하시기 바랍니다.
4. -> How to Apply 를 클릭합니다.
5. -> Printing the Guide and Forms 를 클릭합니다.
이 페이지에서 Guide를 읽어보시고 일반적으로 [IMM 0008], [IMM 0008 SCHEDULE 1] 과 [IMM 5406]서류를 작성하시면 됩니다. [IMM 5467]은 이주공사에 맡기실 경우에 작성합니다.
6. 또한 이 페이지에서 4. Fill out the forms for your visa office를 선택하여
Visa Office Specific Forms -> Asia/Pacific -> Seoul, Korea 에 있는 PDF화일 Appendix B의 Obtaining Police Certificates를 프린트하여 작성합니다. [Note to Applicant]와 [신원확인조회] 서류를 작성합니다.
7. 위 과정에서 작성된 [IMM 0008], [IMM 0008 SCHEDULE 1], [IMM 5406], Police Certificates등과 아래의 <전문인력이민 서류 리스트>에 있는 서류를 준비하여 캐나다 대사관에 접수합니다. 접수비(Processing Fee)는 대사관 1층에 있는 은행에 입금하실 수 있으며 주신청자 $550, 배우자 $550, 22세 이상 자녀 1인당 $550, 22세 이하 자녀 1인당 $150 입니다. 이 금액은 반환되지 않습니다. 예를들어 주신청자, 배우자, 22세 이하 자녀가 2인 일 경우 $550+$550+$300=$1400을 입금하셔야 합니다. 접수 후 약 2주후에 접수 일련번호 File Number가 우편으로 도착합니다.
대사관에서 이민신청서를 처리하는 도중에 영주권 발급 전까지 입금해야 하는 Permanent Residence Fee가 있습니다. 만일 입금하지 않았다면 대사관에서 영주권 발급 전 주신청자에게 입금할 것을 통보하게 됩니다. 금액은 주신청자 $975, 배우자 $975이며 이 금액은 영주권이 발급되지 않거나 영주권 발급 후 이민을 포기하실 경우에는 반환 받으실 수 있습니다.

동사무소에서 FAX신청 또는 우체국에서 관할 구청으로
보내는 행정우편을 통하여 신청하면 3-4일 이내에 등기로

인터넷이나 전화로 신청가능 또는 동사무소에서도 FAX발급가능.

* 부동산 등기부 등본 등기소에 전화로 미리 신청
가능. 온라인 발급 용이. 2부.

부동산 가격 확인서 부동산 114를 통해 가격확인서류
가능(건물분: 부동산 114 사이트 검색, 토지분: 개별공시지가
확인원) 또는 부동산중개업소에서 작성할 수도 있으나
이 때 자녀를 해외 어학연수 보낸다고 할 것. 만일
이민 간다고 할 경우 이민 확정 후 집을 팔고자 할 때 해당부동산에서
집값을 싸게 내어놓는 수가 있다고 함. 2부.

주식잔고 증명원 거래 증권사에서 영문으로 발급
받을 것. 2부
* 은행 통장 잔고 증명서 은행에서 영문으로 발급
받을 것. 통장 사본 필요.
당일 통장 거래가 중단되므로(통장정리도 안된 경우가
있음) 잔고증명하기 전에 미리 통장을 정리하고 잔고증명을
받을 것. 부부가 동일한 날짜에 통장잔고 증명을 받아야
함. 2부
* Job Description (업무설명서) 유일하게 본인이
직접 작성해야 하는 서류. 이주공사에 의뢰한 경우
이주공사에서 제공한 견본을 참조할 수도 있으나 이주공사에서
번역한 서류를 반드시 다시 검토하여 어색한 표현이 있나
확인 할 것. 특히 전공과 관련된 사항은 이주공사의 번역
수준이 어색한 것이 있을 수 있으므로 약자나 용어의 spelling도
반드시 확인할 것.
이 서류가 전문인력이민 서류 중 가장 중요한 것이며
가급적 서류를 심사하는 영사의 입장에서 내용의 순서,
강조, 꾸밈 등을 잘 배치하여 작성할 것. 반드시
파일로 받아두거나 복사하여 추후 취업을 위한 이력서 작성이나
자기소개서 작성시 활용할 것. 1부.

여권사본 여권 유효기간이 연장되었을 경우 연장된
유효기간이 적힌 부분까지 복사. 2부

사진 어른 각 10매. 만 18세 미만의 자녀 각 7매. 사진
뒷면에 반드시 영문이름, 생년월일, 신장을 적어줄 것.
사진 뒷면은 흰색 바탕이어야 함. 비자/여권용 사진과는
틀리므로 반드시 정면으로 찍고 얼굴은 크게 나와야 한다.

추천서 추천서는 필수 제출 서류는 아니지만 간혹
필요하다고 생각되는 경우 첨부해도 좋다. 회사의 상사나
회사추천서 또는 자신을 추천해 줄 수 있는 직위에 있는
자의 추천을 받아도 좋다. 특별한 형식은 없으나 담당업무등에
우수했던 점, 인간적인 면을 강조하면 좋다.

자격증, 교육수료증(Certificate), 세미나 참가증 과거
학원등에서 교육 받은 적이 있을 경우 학원등에서 발급
받는다. 가능하면 영어로 발급 받을 것.

IELTS 성적증명서 또는 영어/불어 능력을 증명할 수
있는 서류. 필수 서류임.
*
학업 및 직업 관련 증빙 서류 만 22세 이상 동반
자녀가 있을 경우에만 해당. 2부.

전세계약서 사본 물론 임차인인 경우에만 해당된다.
2부.
* 부채잔액증명원 부동산에 근저당/장기융자가 설정되어
있는 경우에만 필요. 근저당/장기융자가 설정되어 있는
은행에서 발급. 2부.

캐나다의 친척 확인 증명서류 신청인과 친척관계를
확인할 수 있는 호적 또는 제적등본이 필요. 2부. 캐나다
친척의 영주권 또는 시민권 사본 필요. 2부.

취업비자/학생비자 사본 캐나다에 취업 또는 유학중인
경우

8. 접수 후 인터뷰 면제가 되면 신체검사 통지서가 통보되며,
지정병원에서 신체검사를 받습니다.
9. 인터뷰를 해야 할 경우 약 20-30개월 이내에 인터뷰를
받게 되며, 인터뷰에서 합격할 경우 신체검사를 받습니다.
10. 신체검사에서 이상 없을 경우 대사관으로부터 이민
갈 수 있는 영주권서류를 받게 됩니다.

순수투자이민 (Immigrating to Canada as an Investor)
순수투자이민은 캐나다 이민성 사이트 내의 <Business
Immigrant>중 <Investors>에 해당하는 이민입니다.
다음이 순수투자이민에 대한 정의입니다.
The Immigrant Investor Program seeks to attract experienced
persons and capital to Canada. Investors must demonstrate
business experience, a minimum net worth of CDN $800,000
and make an investment of CDN $400,000.
즉 사업 경험과 캐나다 달라 $800,000의 자산을 증명할
수 있어야 하며, CDN $400,000 를 투자할 수 있어야 합니다.
여기서의 자산은 부채를 뺀 본인, 배우자 명의의
자산을 의미합니다. 거주지 관할 세무서에서 자금출처 확인서를
받습니다.
As an investor, you must make a prescribed investment
of CDN $400,000. This investment is placed with the
Receiver General of Canada.
Participating provinces then use your investment
to create jobs and help their economies grow. Citizenship
and Immigration Canada (CIC) will return your investment
to you, without interest, in approximately five years
after you become a permanent resident.
You may finance your investment. CIC has agreements
with a number of financial institutions, all of which
are members of the Canada Deposit Insurance Corporation
(CDIC), to facilitate the financing of your investment.
순수투자이민을 신청할 수 있는 자격자는 사업을 하는
경우 최근 5년 이내 사업을 하신 경험이나 현재 사업을
하시고 있는 분, 또는 최근 5년 이내 5명 이상이
근무하고 있는 직장에서 2년 이상의 manager 경험이 있으시면
됩니다.
순수투자이민 신청자가 영주권을 취득하기 위해서는
순수투자이민 자격심사 항목의 Pass Mark가 100점 만점에
35점 이상이어야 합니다.
인터뷰를 통과하신 분들은 투자 금액을 캐나다로 송금하여야
합니다.
캐나다 대사관으로부터 통보를 받은 30일 이내에 CDN
$400,000불을 연방정부에 직접 송금하여 투자하시거나 투자프로그램을
갖고 있는 투자회사로부터 투자이민 대출 프로그램을 통하여
투자하시면 됩니다.
40만불을 5년간 투자할 경우 5년 후 이자 없이 원금만을
상환 받으며, 투자이민 대출프로그램으로 투자를 할 경우에는
40만불에 대한 5년 기간 동안 이자를 일시불로 이자를 납부하면
됩니다.
위에서 언급한 연방정부에 순수투자이민을 신청하는
것이 일반적이기는 하지만 퀘백이나 마니토바 등지에 이민신청을
할 수 도 있습니다. 만일 퀘백주로 이주를 원하시는 분들은
퀘백주 이민프로그램이 별도로 있으므로 이를 참조하시면
됩니다. 마니토바의 경우는 Provincial Nominee Program으로
주정부 관할 프로그램이 있으나 이 프로그램으로 발급할
수 있는 영주권수가 상당히 제한되어 있으므로 참조하시기
바랍니다.
신청 후 인터뷰는 보통 24-36개월 이내에 이루어 지고
있습니다. 그러나, 인터뷰 대기기간은 캐나다 대사관의
공지 없이 사정에 따라 바뀔 수 있으므로 유의하시기 바랍니다.
2001년 기준 캐나다 이민성 통계를 참조하면 순수투자이민의
경우 중국 1위 한국이 2위를 랭크하고 있습니다. 2002~2003년
통계는 현재 나와있지 않습니다.

기업이민 (Immigrating to Canada as an Entrepreneur)
기업이민을 신청하시는 분들은 반드시 사업 경험을 증명할
수 있어야 하며, 사업 능력(qualifying business)을 인정
받는 것이 가장 중요합니다. 이민 신청일 이전까지
최근 5년 이내에 2년 이상의 비즈니스 경험 또는 일정 지분으로
경영에 참여한 경험이 있는 분들인 동시에 최소 CAD $30만
달라 이상의 자산증명이 가능하면 됩니다.
지분율은 직원 10명인 회사인 경우 매출액 C$2,500,000
소득(Net Income) C$250,000 자본금(equity) C$ 625,000
이며 지분율 20%입니다. 직원이 4명인 사업체의 경우 매출액 C$1,000,000, 소득액(Net
Income) C$100,000, 자본금 C$250,000 이어야 하며
지분율은 50%입니다. 직원이 2명인 사업체의 경우
앞에 제시된 직원4명 사업체 각 금액의 1/2이며 지분율은
100%입니다.
기업이민 신청자가 영주권을 취득하기 위해서는 순수투자이민
자격심사 항목의 Pass Mark가 100점 만점에 35점 이상이어야
합니다.
기업이민을 신청하여 영주권 취득 후 캐나다에 정착하게
되면 만 3년 이내 1년 이상 캐나다 내에 사업체를 경영하여
조건부 영주권자가 됩니다. 그리고, 일정기간 후
조건해제를 해야 합니다. 과거에는 조건해지를 위한
사업체 규모가 제시되지 않았으나 개정된 이민법에는 조건해지를
위한 사업체 규모가 새로 추가되었습니다.
To qualify as an entrepreneur, you must have business
experience. This means that you must have managed and
controlled a percent of equity of a qualifying business.
Entrepreneurs must have a legally obtained net worth
of at least CDN $300,000.
When you immigrate to Canada as an entrepreneur,
you must have the intention and the ability to control
a percentage of equity of a qualifying Canadian business.
You must provide active and ongoing management of the
qualifying Canadian business. Your business must create
at least one new full-time job for a Canadian citizen
or permanent resident. You must meet these requirements
within three years of becoming a permanent resident.
Before your immigrant visa is issued, you are required
to sign a statement that you intend and will be able
to meet the conditions of permanent residence.
"Entrepreneur"
means a foreign national who
- has business
experience;
- has a legally obtained
minimum net worth; and
- provides a written
statement to an officer that they intend to and will be able to meet the
conditions referred to in subsections 98(1) to (5).
Conditions
(1) An
entrepreneur who becomes a permanent resident must meet the following
conditions:
- the entrepreneur must
control a percentage of the equity of a qualifying Canadian business equal to or
greater than 33 1/3 per cent;
- the entrepreneur must
provide active and ongoing management of the qualifying Canadian business;
and
- the entrepreneur must
create at least one incremental full-time job equivalent for Canadian citizens
or permanent residents, other than the entrepreneur and their family
members.
(3) The entrepreneur
must meet the conditions for a period of at least one year within the period of
three years after the day on which the entrepreneur becomes a permanent
resident.
(4) An entrepreneur
who becomes a permanent resident must provide to an officer evidence of
compliance with the conditions within the period of three years after the day on
which the entrepreneur becomes a permanent resident.
(5) An entrepreneur
must provide to an officer
- not later than six months
after the day on which the entrepreneur becomes a permanent resident, their
residential address and telephone number; and
- during the period
beginning 18 months after and ending 24 months after the day on which the
entrepreneur becomes a permanent resident, evidence of their efforts to comply
with the conditions.
"Business
experience", in respect of an entrepreneur, means the management of a
qualifying business and the control of a percentage of equity of the qualifying
business for at least two years in the period beginning five years before the
date of application for a permanent resident visa and ending on the day a
determination is made in respect of the application.
"Full-time job
equivalent" means 1,950 hours of paid employment.
"Minimum net worth"
means
- in respect of an
entrepreneur, CDN $300,000; and
- in respect of an
entrepreneur selected by a province, the minimum net worth required by the laws
of the province.
"Net assets", in
respect of a qualifying business or a qualifying Canadian business, means the
assets of the business, minus the liabilities of the business, plus shareholder
loans made to the business by a foreign national and their spouse or common-law
partner.
"Net income", in
respect of a qualifying business or a qualifying Canadian business means, the
after tax profit or loss of the business plus remuneration by the business to a
foreign national and their spouse or common-law partner.
"Net worth", in
respect of an entrepreneur, means the fair market value of all of the assets of
the entrepreneur and their spouse or common-law partner minus the fair market
value of all of their liabilities.
"Percentage of
equity" means
- in respect of a sole
proprietorship, 100 per cent of the equity of the sole proprietorship controlled
by a foreign national or their spouse or common-law partner;
- in respect of a
corporation, the percentage of the issued and outstanding voting shares of the
capital stock of the corporation controlled by a foreign national or their
spouse or common-law partner; and
- in respect of a
partnership or joint venture, the percentage of the profit or loss of the
partnership or joint venture to which a foreign national or their spouse or
common-law partner is entitled.
"Qualifying
business" means a business - other than a business operated primarily for
the purpose of deriving investment income such as interest, dividends or capital
gains - for which, in each of any two years in the period beginning five years
before the date of application for a permanent resident visa and ending on the
date a determination is made in respect of the application, there is documentary
evidence of any two of the following:
- that the percentage of
equity multiplied by the number of full time job equivalents is equal to or
greater than 2 full-time job equivalents per year;
- that the percentage of
equity multiplied by the total annual sales is equal to or greater than $500,000
CDN;
- that the percentage of
equity multiplied by the next income in the year is equal to or greater than
$50,000 CDN; and
- that the percentage of
equity multiplied by the net assets at the end of the year is equal to or
greater than $125,000 CDN.
"Qualifying Canadian
business" means a business operated in Canada by an entrepreneur -- other
than a business primarily for the purpose of deriving investment income, such as
interest, dividends or capital gains -- for which there is in any year within
the period of three years after the day the entrepreneur becomes a permanent
resident documentary evidence of any two of the following:
- the percentage of equity
multiplied by the number of full time job equivalents is equal to or greater
than two full-time job equivalents per year;
- the percentage of equity
multiplied by the total annual sales is equal to or greater than CDN
$250,000;
- the percentage of equity
multiplied by the net income in the year is equal to or greater than CDN
$25,000; and
- the percentage of equity
multiplied by the net assets at the end of the year is equal to or greater than
CDN $125,000.
기업이민의 경우 사업계획서를 제출해야 하며 인터뷰
전에 현지 답사를 해야 합니다. 정착예정지에 따라 다소
차이가 있으므로 확인하시기 바랍니다. 사업계획서
제출 시 가능하면 본인이 직접 꼼꼼하게 작성하셔서
확실하게 캐나다에서 기업을 운영할 수 있다는 능력을 보여주셔야
합니다.
주변의 영어를 못하시는 분들도 혼자 수속하여 기업이민에
성공하신 분들이 많습니다. 일단 한글로 사업계획서를 자신 있게 작성하신
후 캐나다 대사관 근처의 번역하는 곳에 맡기시면 매우
저렴하게
이민수속을 하실 수 있습니다. 혼자 수속하신 분들이
오히려 캐나다에서 하실 수 있는 사업에 대한 감각이 높습니다.
직접 수속하시는 동안 대사관에 문의하고 자료를 찾고 서류를
작성하는 과정에서 나름대로 캐나다 사업에 대한 느끼시는
것이 많아 캐나다에서 자신있게 사업하시는 분들이 많으며
차후 조건 해지 시에도 유리할 것으로 판단됩니다.

경우 한국이 1위, 중국이 2위를 랭크하고 있습니다.
